THE PROTECTION OF PERSONAL DATA IN THE HEALTHCARE AREA
This course introduces the Personal Data Protection Code (Legislative Decree no. 196 of 2003) as amended and supplemented following the entry into force of the Legislative Decree 101/2018 on the 19th September 2018.
The European Regulation has on the one hand reiterated and confirmed elements already present in the Code and, on the other hand, brought about significant innovations aimed at guaranteeing a high level of protection of the interested parties and, at the same time, homogeneity in the data processing in the member states of the EU.
Starting from 25th May 2018, all the Member States of the European Union have implemented the General Regulation on the protection of personal data (EU Regulation 2016/679, also known by the English acronym GDPR) and thus defined uniform rules for the protection and the circulation of data within the Union. In Italy, the Personal Data Protection Code (Legislative Decree 196/2003) has been adapted to the Regulation with the Legislative Decree 101/2018. Among the most significant innovations of the new legislation: the principle of accountability of Data Controller (“accountability”), an approach that takes into greater consideration the risks that a certain processing of personal data can cause to the rights and freedoms of the data subjects and the introduction of heavier penalties in case of violations.
The course illustrates the characteristics and implications of the legislation on the protection of personal data, describing the principles that guarantee that the processing of personal data is carried out while respecting the fundamental rights and freedoms, as well as the dignity of the data subject, with special regard to confidentiality, personal identity and the right to the protection of personal data.
The course consists of 6 modules and, once completed, it involves a final learning assessment test.
